Terms and Conditions

1. Scope

These Terms and Conditions govern the use of the platform connective-network.com, operated by the simple partnership "ConnectIve".
By registering or using the platform, all users accept these Terms and Conditions.

2. Service Description

ConnectIve provides a platform where users ("listing creators") can create a listing and set a commission in CHF.

The platform enables:

  • creating and distributing listings
  • providing an individual link for further distribution
  • mediation between the listing creator and a third party ("fulfiller")

ConnectIve exclusively provides the technical infrastructure and is not a contracting party between users.

3. Contractual Relationships

  • An independent contract is created between the listing creator and the fulfiller.
  • ConnectIve is not a party to this contract and assumes no responsibility for content, execution, or success.
  • ConnectIve does not guarantee the suitability or qualification of users.

4. Commission & Payment

  • The listing creator sets the amount of compensation. This compensation is distributed 80% to the fulfiller and 20% as a platform fee to ConnectIve.
  • Payouts are made via bank transfer.
  • Users are obligated to provide correct bank information. ConnectIve is not liable for misdirected transfers due to incorrect data.
  • ConnectIve is entitled to withhold payouts in case of suspected abuse or disputes.
  • If a probation period was agreed upon as part of an employment relationship, the referral commission only becomes due after successful completion of the probation period and corresponding confirmation.

5. Rules for Awarding the Referral Commission

The awarding of the referral commission is subject to the following provisions:

  • Registration requirement: Only registered users with an active ConnectIve account can receive a referral commission.
  • Priority principle: In case of multiple referrals of the same person for the same listing, the person who first submitted a valid fulfillment receives the commission (timestamp principle).
  • Unique assignment: Each referred person can only be recommended once per listing. Multiple referrals of the same person are not compensated separately.
  • Proof of referral: Valid digital proof (e.g., screenshot of communication) is required to receive the referral commission.
  • Confirmation by listing creator: The final commission is only paid after confirmation by the listing creator and successful completion of the referral.
  • No retroactivity: Commission claims only arise with proper submission of a fulfillment through the platform.

6. User Obligations

Users commit in particular to:

  • not publishing illegal content
  • not violating the rights of third parties
  • providing truthful information
  • not using the platform for abusive purposes
  • not creating fake applications, spam, or automated submissions

7. Prohibited Content

Prohibited in particular are:

  • criminal or illegal offers
  • pornographic, violence-glorifying, or discriminatory content
  • content that violates legal regulations or these Terms and Conditions

ConnectIve may delete content or block users without giving reasons.

8. Disclaimer

Users indemnify ConnectIve from all third-party claims arising from user behavior, user content, or contracts between users - including attorney and litigation costs.

  • Use of the platform is at your own risk.
  • ConnectIve makes no warranty for the completeness, accuracy, or availability of the platform.
  • ConnectIve is only liable for intent and gross negligence.
  • Liability for slight or moderate negligence, data loss, or lost profits is excluded.
  • Liability is limited to a maximum of CHF 100.
  • ConnectIve assumes no responsibility for contracts between users.

9. No Identity Verification

ConnectIve does not perform identity, qualification, reference, or background checks. Users act independently and at their own responsibility.

10. Termination of Use

Users can have their listings deleted at any time.
ConnectIve may block users or remove content at any time, especially in case of violation of these Terms and Conditions.

11. Changes to Terms and Conditions

ConnectIve may change these Terms and Conditions at any time.
The current version on the website applies.

12. Applicable Law & Jurisdiction

Swiss law applies exclusively.
Place of jurisdiction is Zurich, to the extent permitted by law.
